Description
We expect decisions of the Supreme Court on cases argued during its most recent term to be released to the public in the spring. This course will consist of two 90-minute discussions of some of the most interesting and important of those decisions. The cases we anticipate discussing address such issues as affirmative action, the scope of administrative agency power, gerrymandering and the independent state legislature theory, conflicts between anti-discrimination laws and the first amendment by providers of goods and services, and internet platforms' liability for violent actions related to material made available or recommended by them. In addition we will discuss other items of interest to the class concerning the Supreme Court, including the mifepristone shadow docket decision and issues surrounding ethical and disclosure obligations of Supreme Court Justices.
