LAW 7425 - Postconviction Law, Policy, and Remedies

Courses in criminal law tend to focus on investigation, prosecution, verdict and sentencing in the criminal justice process.  This course will cover a series of topics that arise after guilt has been determined and the individual has been incarcerated.  Topics will primarily focus on collateral challenges to a criminal conviction – federal habeas corpus and its various state iterations – focusing primarily on ensuring that individuals whose liberty is being denied or restricted have been afforded all the rights they are due and have not been falsely accused and convicted. Specific topics will include federal and state post-conviction remedies, wrongful convictions and claims of innocence, post-conviction procedure and ethical considerations in the postconviction.
